GPT (6-8)- ದಿನಾಂಕ 05/08/25 ರಂದು ಘನ ಉಚ್ಚ ನ್ಯಾಯಾಲಯದ ಡಿವಿಜನ್ ಬೆಂಚ್ ಅಂತಿಮ ತೀರ್ಪು ನೀಡಿದ್ದು 2016 ಶಿಕ್ಷಕರ ವರ್ಗಾವಣೆಗೆ ಅಡ್ಡಲಾಗಿದ್ದ ಶ್ರೀಮತಿ ಕವಿತಾ ಕೇಸ್ ಪ್ರಕರಣವನ್ನು ಮಾನ್ಯ ಮಾಡದೇ ವರ್ಗಾವಣೆ ಕಾಯ್ದೆ ಪ್ರಕಾರ ವರ್ಗಾವಣೆ ಹೊಂದಲು ಅವಕಾಶ ನೀಡಿದೆ. ಘನ ಉಚ್ಚ ನ್ಯಾಯಾಲಯದ ತೀರ್ಪಿನಲ್ಲಿ ಬಹಳ ಸ್ಪಷ್ಟವಾಗಿ
Having heard learned counsel for the parties and on perusal of the entire writ petition papers, we are of the considered opinion that in the facts and circumstances of the present case, it is for the respondent authorities to follow the minimum period of service prescribed under 2020 Act. Admittedly, the petitioners are appointed prior to coming into force of the 2020 Act and the condition of minimum service at the place of first posting is not contemplated under 2020 Act.
The 2020 Act would only provide for minimum period of service in a place of posting to become eligible for transfer.In terms of 2020 Act,a Teacher would become eligible for transfer if he/she has served for a minimum period of service prescribed under the Act. Therefore, it would be expedient for the State Government to give effect to the minimum period of service
prescribed under the 2020 Act instead to the condition of minimum period of service incorporated in the order of appointment With the above observations, writ petitionstands disposed of. In view of disposal of main petition, pending interlocutory applications stand disposed of as not surviving.
ಎಂದು ತಿಳಿಸಿದೆ ಇದರ ಪ್ರಕಾರ ಬಹಳ ವರ್ಷಗಳಿಂದ ನಮ್ಮ GPT ಶಿಕ್ಷಕರ ದೊಡ್ಡ ಸಮಸ್ಯೆ ಬಗೆಹರಿದಿದೆ ಹಾಗೂ 2016 ನ ಬ್ಯಾಚ್ ಶಿಕ್ಷಕರಿಗೆ ಘಟಕದ ಒಳಗೆ ಮತ್ತು ಹೊರಗೆ ವರ್ಗಾವಣೆ ಕಾಯ್ದೆ ಅಡಿಯಲ್ಲಿ ವರ್ಗಾವಣೆ ಸಿಗುತ್ತದೆ. 2023 ರಲ್ಲಿ ನೇಮಕವಾದ ಶಿಕ್ಷಕರು ಕೂಡ 3 ವರ್ಷ ಕನಿಷ್ಟ ಸೇವೆ ಸಲ್ಲಿಸಿದವರೂ ಕೂಡಾ ವರ್ಗಾವಣೆ ಹೊಂದಲು ಅವಕಾಶವಿದೆ (HK ಮತ್ತು 25% ಹೊರತುಪಡಿಸಿ)
